TERMS & CONDITIONS
1. Agreement Overview
By submitting a design request, you enter into a binding agreement with Dumitru-Adrian Păsărin (operating as Adrian DSGNS). Your submission constitutes acceptance of the terms outlined herein.
These Terms and Conditions are subject to change without notice. However, the version in effect at the time of project initiation (communicated via email or PDF attachment) will govern the agreement between Adrian DSGNS and the client.

2. Booking and Scheduling

Projects are booked once availability is confirmed. The client will receive a brief project form to complete, which must be submitted at least 7 days before the scheduled start date to determine the visual direction.

Before the deposit is issued, Adrian DSGNS may review the project brief, discuss the main details with the client, and prepare an initial sketch, layout, or concept direction. This preliminary stage is intended to establish the general visual direction of the project before the full design process begins.

Once the brief has been reviewed, the main details have been discussed, and an initial sketch or concept direction has been prepared, a 50% deposit invoice will be issued. The deposit must be paid before the project moves into the full design and finalization stage.

The first full draft is usually delivered on the scheduled start date. However, depending on the complexity of the cover, the duration of the preliminary sketch/concept stage, client response time, or the amount of discussion required before approval, the first draft delivery may be adjusted by several business days. Any timeline adjustments will be communicated to the client as soon as possible.

Clients are expected to provide feedback within 5 business days of receiving a draft. If feedback is delayed beyond this period, the project may be rescheduled to the next available slot.

No resources will be purchased without prior client approval. If a project is postponed after design work begins, it will be put on hold and resumed at a later agreed date.
3. Payments and Methods

Deposit | First Invoice: For custom design projects, a 50% non-refundable deposit is required after the project brief has been reviewed, the main details have been discussed, and an initial sketch or concept direction has been prepared. The deposit confirms the client’s approval to move forward with the full design process and secures the project. The deposit will be issued as an invoice through Stripe.

Any sketches, drafts, or concept materials shared before payment remain the intellectual property of Adrian DSGNS and may not be used, edited, shared, reproduced, or given to another designer without written permission.

Final Payment | Second Invoice: The remaining 50% is due upon project completion and before the delivery of any final files. Once the project is completed, Adrian DSGNS will issue a second invoice through Stripe for the remaining balance.

Payments for Premades: In the case of premade book covers, payment is made in full when ordering the cover, unless otherwise agreed in writing. Once payment is received and the cover is being processed, the cover is marked as sold and the requested revisions are made.

Payment Method: Payments are primarily processed through Stripe. Adrian DSGNS may, at his discretion, accept alternative payment methods such as Wise or bank transfer if agreed in writing before payment.

Pricing and Project Scope: Service rates are listed on the Pricing page. The project includes only the deliverables expressly agreed upon in writing, such as ebook cover, paperback, hardcover, dust jacket, naked case, printed edges, promotional materials, or other add-ons. Any additional deliverables requested after the project has started may incur additional fees and will be discussed before commencement.
4. Cancellations and Refunds

Before Project Commencement: Cancellations made before work begins are free of charge, provided no payment has been made.

After Project Commencement: If work has started, the initial 50% deposit is non-refundable.

Premade Covers: Premade book covers are paid in full when ordered and are non-refundable once payment has been made. After payment, the cover is marked as sold and removed from availability. If the client cancels or postpones the customization process, the payment remains non-refundable, as the cover has already been reserved and taken off the market.

No Refunds: Due to the custom nature of the work, refunds are not provided once the design process has commenced. Premade covers are also non-refundable under any circumstances. However, minor changes or resell/relocation options may be discussed if the cover no longer fits the client's needs.
5. Revisions

Minor adjustments such as text changes, font alterations, and small color modifications are included at no extra cost.

Major Revisions*: the price includes up to 3 significant changes, such as layout, models, or background changes etc. Additional revisions may incur extra fees.

Initial Sketch | Concept Stage: The initial sketch or concept stage is intended to establish the main visual direction of the project before the full design process begins. Once the direction has been approved and the deposit has been paid, major changes that depart from the approved direction may count as significant revisions.

Revision Requests: All revision requests should be made within 14 days of receiving the last version. After this deadline, any changes may be charged.
* In case of fully illustrated artworks, the 3 major revisions (layout, composition, elements) take place during the sketch phase. Once the sketch is approved, the design moves into final rendering, and only smaller adjustments are included. Structural changes after this stage may incur additional fees.
6. Acknowledgment
You agree to credit Dumitru-Adrian Păsărin (Adrian DSGNS) in all formats where the design is used:

7. Licensing and Usage Rights

The Client warrants that they hold all necessary rights, trademarks, and permissions for any materials they provide to Adrian DSGNS for use in the design process. The Client agrees to indemnify, hold harmless, and defend Adrian DSGNS from all copyright or permission infringement actions resulting from materials supplied by the Client.

Unless otherwise expressly agreed in writing and paid for as a full copyright transfer, all intellectual property rights and copyright to the created design remain the sole property of Adrian DSGNS.

After full payment has been received, the Client is granted an exclusive, non-transferable license to use the final design for the agreed purpose (book cover, interior book designs, marketing materials). This license does not include the right to modify, resell, redistribute, or claim ownership of the artwork.

The Client may share the final files with publishers, formatters, printers, or marketing professionals solely for the purpose of producing, publishing, printing, or promoting the agreed book/project. This does not grant permission to resell, redistribute, alter, reuse, or transfer the artwork for unrelated projects.

Any full transfer of copyright must be negotiated and confirmed in writing and is subject to a substantially higher fee than the original project price, reflecting the complete cessation of ownership and rights by Adrian DSGNS.

The Client is not allowed to alter, share, or edit the files provided without Adrian DSGNS’ written permission.

The use of Adrian DSGNS’ artwork or any part thereof for merchandise or physical goods (such as prints, mugs, tote bags, or any other commercial products) is strictly prohibited without prior written consent from Adrian DSGNS. A separate licensing agreement and additional fees will apply for such use.

Image Licensing: Images sourced from Depositphotos (or other third-parties) under the Standard License are limited to 500,000 copies. For higher quantities, an Extended License is required. help.depositphotos.com

The acquisition of an extended license includes two components:

The Client must purchase extended licenses for all third-party stock resources used in the creation of the cover design (including, but not limited to, stock photos, textures, fonts, or 3D elements).

The Client must also pay Adrian DSGNS 50% of the original project price as a designer’s extended license fee. This payment grants the Client the extended right to continue selling the book featuring Adrian DSGNS’ artwork beyond the initial 500,000-copy limit and reflects fair recognition of the designer’s contribution to the project’s success.

In cases where the book cover is entirely hand-created by Adrian DSGNS (meaning no third-party stock resources were used and the artwork is 100% original), the Client must pay the full original project price again to obtain the extended license. This payment compensates Adrian DSGNS for granting extended commercial rights to the Client for the continued sale and distribution of the book.

File Delivery and Storage
Upon final payment, the client will receive the final design files, including the editable source files (PSD). The client is responsible for downloading and securely storing all delivered files.
Adrian DSGNS will retain a backup copy of the project files for up to 6 months after project completion. After this period, files may be permanently deleted and Adrian DSGNS cannot guarantee their availability.
8. Use of AI and Illustrations

Generative AI: Adrian DSGNS does not incorporate any AI-generated content or imagery in the design work presented. All creative decisions and outputs are the result of manual design processes and human creativity, ensuring originality and authenticity in every project.

Furthermore, feeding or uploading any of Adrian DSGNS’ creations, designs, or images into any AI or generative platform (including but not limited to Midjourney, ChatGPT, Firefly, DALL·E, or similar tools) is strictly prohibited. Doing so constitutes an unlawful act of copyright infringement. Adrian DSNGS reserves the right to take legal action to protect his intellectual property if such unauthorized use occurs.

Original Illustrations: All illustrations featured in Adrian DSGNS’s work are either personally created by Adrian DSGNS or legally obtained from reputable, licensed sources. This guarantees that all visual elements comply with copyright laws and maintain the highest standards of quality and integrity.
9. Client-Provided Materials
You confirm that any materials provided (e.g., images, text) are owned by you or that you have obtained the necessary permissions for their use. Adrian DSGNS is not liable for any copyright infringements arising from client-supplied content.
10. Confidentiality and Data Protection

Data Handling: All client information, including billing details, is treated as confidential and stored securely.

GDPR Compliance: Adrian DSGNS complies with the General Data Protection Regulation (GDPR) regarding the collection and processing of personal data.

Portfolio Use: Designs will only be showcased in Adrian DSGNS's portfolio after public release or with your explicit consent.

Payment Processing: Payment and billing information may be processed through third-party payment providers such as Stripe, Wise, or banking institutions, depending on the agreed payment method. These providers process payment data according to their own privacy policies and security standards.
11. Portfolio Policy

Showcasing Designs: Completed designs may be featured in the Adrian DSGNS portfolio post-publication, including on the official website and across Adrian DSGNS’s social media channels.

Unrevealed Projects: If a design remains unrevealed two years after completion and no extension has been requested, Adrian DSGNS reserves the right to display the work in the portfolio and on social media platforms.

For print editions, a complimentary copy of the published book is appreciated (but not mandatory) for portfolio archiving purposes.
12. Proofing and Liability
The client is responsible for proofreading all materials and approving all final text, layout details, dimensions, and print specifications before final delivery. Adrian DSGNS is not liable for errors after final approval.
For print editions, the client is responsible for providing accurate and up-to-date printer specifications, templates, trim sizes, spine widths, bleed requirements, and any other technical requirements needed for file preparation. Adrian DSGNS is not responsible for printing issues, rejected files, production delays, or additional costs caused by incorrect, outdated, or incomplete specifications provided by the client or printer.
Additionally, Adrian DSGNS is not responsible for printing issues or costs incurred due to design errors post-approval.
13. Governing Law
These terms are governed by the laws of Romania. Any disputes will be resolved under Romanian jurisdiction.
14. Severability
If any provision of this agreement is found to be invalid, illegal, or unenforceable by a court or competent authority, the remaining provisions shall continue in full force and effect. The invalid provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed without affecting the remainder of the agreement.
