Reading this form and submitting a request is a legal contract between Dumitru-Adrian Păsărin (referred to as Adrian DSGNS) and the client. The information entered by the client is a legally binding signature of everything contained within this agreement.

PAYMENTS & METHODS

 

The client will proceed to pay half of the total amount (50% of the project price) at the beginning of the project. This part of the payment will represent the money needed to acquire the licenses for the resources used to create the design, but also the guarantee that the customer will fulfil his obligations. The client will pay the other 50% at the end of the project after the design is final. THE EXCEPTION to this rule is the Custom Premade Package – the payment process starts after the design is done and the client is sure that they want to buy it.

The price packages for book covers are fixed, but there might appear extra fees for extra services if the client requires them.

If required, the payment can be made following an INSTALMENT PLAN. The requirements for instalments are:

- The 50% deposit at the beginning of the project is no longer needed - instead, the client will pay the amount of the first instalment;

- The client will pay at least $40 per month until the total amount is paid;

- The client will be charged an extra fee of $40;

- Each payment made later than the date mutually agreed between the client and Adrian DSGNS will be charged a fee of $10.
- The instalment plan is available only if the client buys products and services that cost, in total, at least $200.

For example, for a $200 cover, the customer will have to pay $240. If they pay the minimum for each instalment, that means they will pay a total of 6 instalments of $40 each. Delaying an instalment will increase the total price by an additional $10. So for 3 delayed instalments, the final price of this cover will be $270.

The payments will be made using Paypal.

All my prices are displayed on my Pricing page and any extra charge will be discussed with the client before making the product or service that the client required.

CANCELATIONS

AND REFUNDS

 

Any cancellations made by the client before  Adrian DSGNS starts working on the project required are free of charge. In this case, the client did not make any payment before the cancellation. 
Any cancellations made by the client after  Adrian DSGNS started working on the project required will be charged. This means that the 50% deposit won't be refunded to the client. 

 

If the client asks for a premade (and/or add-ons), the client will have to pay a compensation of 50% of the price of the entire project if the client wishes to cancel or postpone the project in case. If the client canceled the project, the premade will be brought to the original state and put up again for sale. If the client wished to postpone the project, the files will be put on hold and the project will restart at the date the client and Adrian DSGNS agreed upon.

There are no refunds for premade book covers, though each one upon being bought will be considered exclusive towards each client. If the client purchased a premade book cover that happens to not meet their needed requirements, the client can reach Adrian DSGNS for the possibility of relocating the premade cover or additional modifications. If the client and Adrian DSGNS reach an agreement and the client is allowed to relocate the cover, that cover will only be relocated to someone else for the SAME price (or lower) the initial client has paid for it.
The relocation process will be handled by the original client.

REVISIONS

​

Upon agreement of the first initial draft, which includes main images, concepts of backgrounds, editing services, and overall design, the client can ask at any time for revisions. Free-of-charge revisions include:
1. Text (change of title / author name / subtitles / blurb / etc);
2. Fonts and text styles or text placement;
3. Small changes such as hair or eye colour/magic colour/body marks/tattoos, etc.
4. Resizings for online use or printing.

Paid revisions include complicated changes that might alter the overall look of the original design and changes that require more time to be completed and reintegrated into the overall design. Such revisions include changes in models or objects' position; replacement of models or objects; adding more objects or models; changes of background; etc.
 

Any requests which do not meet industry standards, genre-appropriate design, or any offensive or explicit ideas which violate terms of service will not be allowed. If the client needs a revision that has not been named above, please contact Adrian DSGNS via email or the contact page. Adrian DSGNS will get back with an answer within 48 hours.

CREATION ACKNOWLEDGES

​

Client agrees in all forms to add the following to formats in any form of ebook, print copy, audiobook, or future forms of creative content to acknowledge Adrian DSGNS (Dumitru-Adrian Păsărin) of their work with full writing or hyperlinks therein:

1. Physical Copies: Cover Design by Dumitru-Adrian Păsărin

2. Digital Copies: Cover Design by Dumitru-Adrian Păsărin

LICENSES

​

All rights and permissions are obtained and held by the client regarding trademarks, licenses, and distribution of the materials. Client agrees to identify, hold harmless and defend Dumitru-Adrian Păsărin (Adrian DSGNS)  from any and all copyright and permission infringement action resulting from materials the client provides. Exclusive rights to the works done and needed are given to the client after full payment is processed and received by Adrian DSGNS. The client is not allowed to alter or edit the files provided without Adrian DSGNS' permission.

IMAGES FOR DESIGN

​

All images licensed by a third party are for materials of up to 500,000 copies in digital or print – for an extended license, please check beforehand if needed and an additional fee will apply for an extended and or enhanced license. Adrian DSGNS retains the right to use the client’s final book cover design, name, and book title (or any other design that is not a book cover) in Adrian DSGNS' portfolio and to market and promote his services. Adrian DSGNS retains copyright and ownership of all design and draft materials. Modification of any kind (removing or adding text, change of colours, change of dimensions, etc) of the designs is NOT allowed by third parties. Any needed modification or revision of the original design will be made only by Adrian DSGNS.

The client must legally own any provided images or have rights to them, and takes full responsibility for any actions or claims against images. No responsibility or action is provided by Adrian DSGNS.

CONFIDENTIALITY

All client information is confidential and only to be utilized by Adrian DSGNS to complete the designs required. This is classified information that will not be given out or shared with any third party. The final design can be shared in the artist's portfolio only after the client has revealed the design, or has given Adrian DSGNS written permission to reveal it.

Adrian DSGNS will not be held liable when an artwork is deemed similar to other artworks merely based on general cover trends, themes, and genres.

PROOFING

​

The client must test and try proofing of printing. At no time will Adrian DSGNS be held financially or legally responsible for any problems, costs, fees or expenses incurred by the client as a result of using the book cover design. Adrian DSGNS is not liable for incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including loss of revenues or profits, loss of business or reputation, or loss of data, in any way related to our services. Adrian DSGNS is not responsible for any claim, loss, or injury based on errors or any other inaccuracies appearing on our site or in our clients’ written documents, including without limitation as a result of any breach of the terms and conditions of this agreement.

COMPLETE AGREEMENT

​

This agreement is the entire agreement of all parties. No additional promises or conditions, written or oral, apply to this agreement that is not included herein.

APPLICABLE LAW

​

All images presented on this website have been created with paid resources for commercial use or free resources for personal use. The final products of those creations belong to Dumitru-Adrian Păsărin (Adrian DSGNS). Any sort of alteration of Adrian DSGNS images (cropping, removing text, changes of colour, adding filters or overlay, etc.) is not allowed. Redistribution of Adrian DSGNS' works is NOT allowed without giving rightful credit (website, social media, etc). and without Dumitru-Adrian Păsărin's written permission.

Do not claim any of the images presented on this website as your own. They are the property of Dumitru-Adrian Păsărin and any unrightful claim will represent theft and will be treated as such.

By agreeing to these Terms and Conditions you also acknowledge and expressly agree that this agreement will be governed by the laws of Romania. The Courts of Romania shall have exclusive jurisdiction over all disputes between the parties. In case of a conflict or a dispute, both parties agree to try to resolve the dispute amicably, and only in case of failure will they refer it to the competent courts.
